If you are using Engage on behalf of a business, you confirm that you have authority to bind that business to these terms.

Engage provides software and related services for customer communication, messaging operations, billing management, automation, reporting, and integrations.

Some parts of the service may rely on third-party providers such as messaging platforms, hosting providers, payment processors, or integration partners. Availability of those services may affect parts of the Engage platform.

You are responsible for maintaining the security of your account, login credentials, team access, and devices used to access the service.

You are also responsible for actions taken by users who access the platform through your account or workspace.

You may not use Engage for unlawful, fraudulent, abusive, deceptive, harmful, or unauthorized activity. You may not interfere with the platform, attempt unauthorized access, or use the service in a way that harms other users or providers.

You are responsible for following all applicable rules, including messaging rules, advertising requirements, privacy obligations, and third-party platform policies such as WhatsApp Business and Meta platform requirements.

You are responsible for the data you upload, store, send, or process using Engage, including contact data, message content, templates, product data, and campaign content.

You represent that you have all rights, permissions, notices, and consents required to use that data and communicate with your customers.

Some features of Engage require payment, wallet funding, or plan-based access. You agree to pay applicable charges, taxes, and fees associated with your use of the platform.

Wallet balances, recharge flows, and usage charges may be subject to product-specific rules shown in the billing section of the platform.

We work to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change over time as the product evolves.

We may update, improve, suspend, or discontinue parts of the service where necessary for business, technical, operational, or legal reasons.

We may suspend or terminate access if we believe there is a violation of these terms, misuse of the platform, failure to pay applicable charges, security risk, legal obligation, or harmful conduct affecting the platform or other users.

You may stop using the service at any time, subject to any billing or contractual commitments already incurred.

Engage and its related software, branding, design, and documentation are owned by us or our licensors. These terms do not grant you ownership of the platform or our intellectual property.

You retain ownership of your own content and data, subject to the rights required for us to operate and support the service.

To the extent permitted by law, the platform is provided on an “as is” and “as available” basis. We do not guarantee that the service will meet every requirement or be free from every interruption or defect.

To the extent permitted by law, Engage will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, profits, goodwill, or business opportunity arising from use of the service.

We may update these Terms of Service from time to time. Continued use of the service after changes become effective means you accept the updated terms.
